1. Acceptance of Terms
By purchasing hardware, using hosted services, accessing software, or interacting with any system provided by Crowetic Hardware Development, LLC (“CHD”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use CHD products or services.
These Terms apply to all CHD offerings, including but not limited to:
- Hardware sales and devices manufactured or distributed by CHD
- Hosted services, cloud systems, and virtualized infrastructure
- Email services and related mail scanning
- Software projects including:
- Qortal Core
- Qortal Hub
- Qortal Go
- Nextcloud server and sync clients
- Nextcloud Talk
- CyberPanel and all CyberPanel-based mail services
- MailScanner and related filtering software
- Ubuntu Linux and all other Linux Versions used by CHD in build of any hardware.
2. Return Policy
- Hardware: Returns are accepted only if the device is Dead on Arrival (DOA). DOA claims must be submitted within 7 days of delivery.
- Replacement: Any other issues identified within 30 days of hardware delivery will be handled through replacement or repair at CHD’s discretion.
- Refunds: Refunds are issued only in the case of verified DOA hardware and CHD having no suitable replacement within 30 days.
- Procedure: Contact CHD Support with serial numbers, photos, and requested diagnostics for return authorization. Return shipments are covered by CHD only in the case of DOA hardware properly disclosed to CHD within 7 days as described above.
3. Service Policy
3.1 User Responsibility
- All data stored, transmitted, or published through CHD-hosted services is the sole responsibility of the user.
- All connections made to or from CHD servers (except those originating from CHD itself) are the sole responsibility of the user.
- CHD is not liable for any consequences, legal or otherwise, arising from user data, content, or connectivity.
3.2 Liability for Server Use
- Any issues arising from data present on a hosted server, regardless of how discovered, are the sole responsibility of the renting party.
- Any malicious activity, illegal content, or unauthorized use traced to a user’s hosted server is the sole responsibility of that user.
3.3 Logging & Privacy
- Diagnostics Logs: Retained for up to 30 days during initial onboarding (typically 3–6 months). After that, logs are retained for no more than 24 hours and used solely for diagnostics.
- Privacy Commitment: Logs are never shared with third parties except under valid court order in CHD’s jurisdiction.
- Future Plan: CHD intends to eliminate all logging within one year from October 2025. (October 2026+)
3.4 Email Services
- All email content and activity are the sole responsibility of the user.
- Diagnostic logs are retained for up to 60 days (with a goal of 15 days) for troubleshooting.
- Email scanning (virus, malware, spam) is fully automated. No CHD employee or partner has access to message content.
4. Service Availability & Backups
- Service Uptime: Hosted services are guaranteed to be operational. In the event of downtime caused by disaster or system failure, service payments will be paused until normal operation resumes.
- Backups: CHD maintains backups of hosted services in at least one off-site location (typically more).
- QDN Backups: Provided only upon request or explicit agreement, and not guaranteed until full automation is implemented.
- Downtime, Data Loss, and any resulting issues therein, are the responsibility of the user. Only downtime caused by unforeseen events or system failures is the responsibility of CHD, and no refunds will be given for downtime, but service payments will be paused. CHD is not responsible for any data loss or resulting issues regardless.
5. Account Termination
CHD reserves the right to terminate any account, subscription, or hosted service at any time, with or without cause, at its sole discretion.
- If terminated, the user’s subscription will end at the scheduled renewal date.
- Services will be cancelled immediately upon termination, regardless of any remaining subscription time.
- CHD is not responsible for any data loss, downtime, or consequences resulting from account termination.
6. Warranty Disclaimer
- Hardware: Warranted only against DOA at delivery and for replacement or repair within 30 days of purchase.
- Services: Provided “as-is” and “as-available” without warranties of any kind, express or implied, beyond the stated uptime guarantee.
- CHD disclaims any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Users are responsible for maintaining independent backups of their data.
7. Prohibited Uses
Users agree not to use CHD hardware, software, or hosted services for:
- Illegal, harmful, or malicious activities (‘malicious’ defined by CHD and at sole discretion therein.)
- Transmission of spam, malware, or unauthorized access attempts
- Hosting of illegal content or infringing material made public.
- Activities that violate applicable laws or regulations.
Violation of these terms may result in immediate termination without notice.
8. Limitation of Liability
To the maximum extent permitted by law:
- CHD shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of data, profits, or revenue.
- CHD’s total liability for any claim shall not exceed the total amount paid by the user in the preceding 12 months for the specific service in question.
9. Dispute Resolution
- CHD strongly encourages direct communication between the user and CHD to resolve disputes.
- If no resolution is reached, out-of-court arbitration is the preferred method of dispute resolution.
- If legal proceedings become necessary, they shall take place in the courts of Washoe County, Nevada, United States, and the losing party shall bear all associated legal costs.
10. Governing Law
These Terms are governed by and construed under the laws of the State of Nevada, United States, without regard to its conflict of law principles.
11. Reservation of Rights
All rights not expressly granted in these Terms are reserved by CHD. Use of CHD’s services or hardware does not transfer any ownership or intellectual property rights.
12. Changes to These Terms
CHD reserves the right to modify or update these Terms at any time. Updates will be posted on the official CHD website. Continued use of CHD products or services after changes constitutes acceptance of the revised Terms.
